Website Terms of Use

These Website Terms of Use (the "Terms") govern access to and use of the website operated by Bassett Homes, LLC, including all pages, plan previews, images, text, renderings, downloads, ordering functions, and related services (collectively, the "Site"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. Company Information

Bassett Homes, LLC is a North Carolina limited liability company. Notices may be sent to bassetthomedesign@gmail.com. References to “Bassett Homes,” “we,” “us,” or “our” mean Bassett Homes, LLC and its authorized representatives.

2. Eligibility and Authority

You must be at least eighteen years old and legally capable of entering a binding agreement. If you use the Site for a company, builder, developer, trust, or other entity, you represent that you have authority to bind that entity.

3. Site Content and Ownership

The Site and its contents—including home designs, building designs, plans, drawings, floor plans, elevations, roof plans, notes, images, renderings, photographs, graphics, logos, product names, copy, and file organization—are owned by or licensed to Bassett Homes and are protected by copyright, trademark, contract, and other applicable law. No ownership right is transferred by viewing the Site or purchasing a plan.

4. Limited Permission to View the Site

Bassett Homes grants you a limited, revocable, nonexclusive, nontransferable permission to access and view publicly available Site content solely to evaluate whether to purchase a license. This permission does not authorize downloading, screenshotting, tracing, measuring, reproducing, adapting, reverse engineering, distributing, displaying, publishing, transmitting, scraping, training an artificial-intelligence system on, or commercially exploiting any Site content unless expressly authorized in writing.

5. Prohibited Conduct

You may not: (a) copy, trace, redraw, scan, photograph, screen-capture, scrape, extract, or recreate a plan or design; (b) remove or obscure a watermark, copyright notice, metadata, customer identifier, or security feature; (c) use Site content to create a competing or substantially similar design; (d) upload plans or images to a plan marketplace, social platform, file-sharing service, generative-AI service, or other third-party system except as expressly necessary for the authorized project; (e) resell, sublicense, transfer, lend, publish, or distribute any plan; (f) use automated systems to access the Site; (g) interfere with Site security or operation; or (h) misrepresent affiliation with Bassett Homes.

6. No Project-Specific or Regulated Professional-Services Relationship

Use of the Site, communications through the Site, and purchase of a pre-designed plan do not create a custom-design, engineer-client, contractor-client, fiduciary, advisory, or other project-specific professional-services relationship. Bassett Homes is not retained as the project’s local design professional, engineer of record, contractor, construction manager, code consultant, surveyor, inspector, or permit applicant. Any separately offered product modification or service must be governed by a separate written agreement that defines its limited scope.

7. Plan Purchases

Each plan purchase is governed by the Digital Plan Purchase and Single-Use License Agreement presented at checkout, the plan-specific order information, and any signed addendum. Website descriptions and renderings are marketing summaries and do not expand the included deliverables or license scope.

8. Accuracy of Product Information

Bassett Homes prepares its delivered home plan sets with reasonable care and intends them to accurately depict the selected design. Site descriptions, dimensions, square footage, room names, materials, finishes, colors, renderings, and photographs may be summarized, rounded, illustrative, or based on a constructed variation. The delivered plan set and Order Summary control. No Site statement is a warranty of lot fit, local-code compliance, permit approval, construction cost, or suitability for a particular project.

9. Third-Party Services and Links

The Site may link to payment processors, e-signature providers, contractors, social media, or other third-party services. Bassett Homes does not control and is not responsible for third-party services, terms, security, availability, advice, products, or conduct.

10. Electronic Communications

You consent to receive transaction records, agreements, receipts, download notices, and other communications electronically. You are responsible for maintaining an accurate email address and the hardware and software needed to access and retain PDF and electronic records.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL SITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR RESULTS. NON-WAIVABLE WARRANTIES, IF ANY, ARE LIMITED TO THE MINIMUM PERIOD AND SCOPE REQUIRED BY LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BASSETT HOMES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS OR REVENUE; LOSS OF DATA; DELAY; LOSS OF USE; BUSINESS INTERRUPTION; OR COSTS OF SUBSTITUTE GOODS OR SERVICES ARISING FROM THE SITE. BASSETT HOMES’ AGGREGATE LIABILITY ARISING FROM GENERAL SITE USE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100), EXCEPT TO THE EXTENT A DIFFERENT LIMIT APPLIES UNDER A PLAN-SPECIFIC AGREEMENT OR NON-WAIVABLE LAW.

13. Indemnification

You will indemnify and hold harmless Bassett Homes and its owners, officers, employees, and agents from third-party claims, losses, liabilities, damages, and reasonable costs arising from your unlawful use of the Site, infringement or misuse of Site content, violation of these Terms, or material misrepresentation. This provision does not require indemnification for liability finally determined to have been caused by Bassett Homes’ own negligence or willful misconduct to the extent such indemnification is prohibited by law.

14. Copyright Complaints

Copyright complaints and reports of unauthorized use should be submitted under the Copyright and DMCA Policy posted on the Site. Bassett Homes may preserve evidence, suspend access, terminate licenses, issue takedown requests, and pursue contractual and statutory remedies.

15. Suspension and Termination

Bassett Homes may suspend or terminate Site access, cancel an unfulfilled order, disable a download link, or revoke permission to use Site content if it reasonably believes there has been fraud, infringement, unlawful conduct, a security threat, a material breach, or an erroneous transaction. Termination does not eliminate accrued payment obligations or remedies for prior misuse.

16. Dispute Resolution

Before filing a claim, a party must send written notice describing the dispute and requested relief and allow thirty days for informal resolution. Except for eligible small-claims matters and claims seeking injunctive relief for infringement, misappropriation, confidentiality breaches, or unauthorized use of plans, disputes will be resolved by binding individual arbitration under the then-current consumer rules of the American Arbitration Association. No class, collective, consolidated, or representative proceeding is permitted. A purchaser may opt out of arbitration by sending written notice within thirty days after first accepting these Terms. Court proceedings permitted under this section must be brought exclusively in the state or federal courts serving Mecklenburg County, North Carolina, and each party waives trial by jury to the extent permitted by law.

17. Governing Law

North Carolina law governs these Terms without regard to conflict-of-law rules, except that federal law governs federal claims. Mandatory consumer protections of a purchaser’s home jurisdiction apply only to the extent they cannot lawfully be waived.

18. Changes to the Terms

Bassett Homes may revise these Terms prospectively. The version accepted at the time of a completed plan purchase will continue to govern that purchase unless the parties agree otherwise in writing.

19. General Provisions

If any provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent. Bassett Homes may assign them in connection with a merger, reorganization, asset sale, or transfer of the business or intellectual property. Headings are for convenience only. Electronic acceptance and records have the same effect as signed paper records to the extent permitted by law.
